Welcome to Oh, Belle.

These Terms & Conditions ("Terms") govern your use of the Oh, Belle website and online store, including the purchase of our products and your use of any related services, features and content (collectively, the "Services").

In these Terms, "Oh, Belle", "we", "us" and "our" refer to Oh, Belle, and "you" or "your" refers to the person using our Services or purchasing our products.

Our website is powered by Shopify, which provides the technology that enables us to operate our online store.

Please read these Terms carefully before using our website or placing an order. By using our website or purchasing from Oh, Belle, you agree to these Terms, together with our Privacy Policy and Returns, Exchanges & Refunds Policy.

Nothing in these Terms is intended to exclude, restrict or limit any rights you may have under applicable South African law, including the Consumer Protection Act 68 of 2008 ("CPA"), the Electronic Communications and Transactions Act 25 of 2002 ("ECTA"), or the Protection of Personal Information Act 4 of 2013 ("POPIA").

Where a provision of these Terms conflicts with a mandatory provision of applicable law, the applicable law will prevail.

1. Using Our Website

You may use our website for lawful purposes and in accordance with these Terms.

By using our website or placing an order, you confirm that the information you provide to us is accurate, complete and current.

If you create an account, you are responsible for keeping your login information secure and for activities carried out through your account.

You should notify us if you believe that your account or login details have been accessed or used without your permission.

2. Age Requirements

You must be at least 18 years old to enter into a purchase transaction with Oh, Belle, unless otherwise permitted by applicable South African law.

If you are under 18, you may only use our website or purchase products with the involvement and consent of a parent or legal guardian where required by law.

3. Our Products

We make reasonable efforts to ensure that the descriptions, photographs, colours, measurements and other information relating to our products are accurate.

However, please note that:

  • Colours may appear differently depending on your screen, device and settings;

  • Handmade products may have slight variations in appearance, measurements and finish;

  • Products made from reclaimed or deadstock materials may have natural variations;

  • Availability of certain fabrics, colours and materials may be limited; and

  • Product photographs may contain styling or other items that are not included with the product unless expressly stated.

Where a product is made using reclaimed, deadstock or other previously manufactured materials, variations in colour, texture or appearance may occur. These variations are part of the nature of the material and do not necessarily constitute a defect.

We will provide material information about our products, including relevant measurements, materials and care instructions, where applicable.

Nothing in this section limits your statutory rights if a product does not comply with the requirements of applicable consumer protection law.

4. Product Availability

We operate Oh, Belle in limited quantities and some products may be made in small batches or may be available only while stocks last.

We may discontinue products or change product designs, materials or availability from time to time.

If a product becomes unavailable after you have placed an order and we are unable to fulfil the order, we will notify you and provide the appropriate remedy in accordance with applicable law.

5. Orders

When you place an order through our website, you are submitting an order to purchase the selected products.

Your order will be subject to confirmation and acceptance by Oh, Belle.

We may decline or cancel an order where reasonably necessary, including where:

  • A product is unavailable;

  • There is an obvious pricing or product description error;

  • We reasonably suspect fraudulent or unlawful activity;

  • We are unable to verify information necessary to fulfil the order; or

  • Circumstances outside our reasonable control prevent us from fulfilling the order.

If we cancel an order after payment has been received, we will provide the appropriate refund or other remedy in accordance with applicable law.

We will provide you with an order confirmation containing relevant transaction information.

Please check your order carefully before completing your purchase.

6. Prices

All prices displayed on our website are in South African Rand (ZAR) unless otherwise stated.

We make reasonable efforts to ensure that prices displayed on our website are accurate.

Prices may change from time to time, but a price change will not affect an order that has already been accepted and confirmed, except where a correction is required because of an obvious error or where otherwise permitted by law.

Where applicable, prices will indicate whether VAT is included.

Delivery or shipping charges will be displayed separately where applicable before you complete your purchase.

Any promotional pricing will be subject to the terms communicated with the relevant promotion.

7. Payment

Payment must be successfully processed before an order can be fulfilled, unless we have expressly agreed to another payment arrangement.

Payments may be processed through Shopify or third-party payment service providers.

You confirm that you are authorised to use the payment method provided for your purchase.

We do not knowingly retain complete payment card information on our own systems. Payment information may be processed by the relevant payment provider in accordance with its own terms and privacy practices.

8. Shipping and Delivery

We will provide the available delivery options and applicable delivery charges during the checkout process.

We will make reasonable efforts to dispatch orders within the timeframe communicated to you.

Delivery times are estimates and may be affected by circumstances outside our reasonable control, including courier delays, strikes, weather, service interruptions or other unforeseen events.

If there is a significant delay in fulfilling your order, we will communicate with you where reasonably possible.

We remain responsible for fulfilling our obligations to you under applicable South African consumer law.

Nothing in these Terms is intended to transfer statutory responsibilities to you merely because a third-party courier is used.

Where applicable law provides you with rights relating to delivery, cancellation or non-performance, those rights will apply.

9. Returns, Exchanges and Refunds

Our Returns, Exchanges & Refunds Policy forms part of these Terms.

Our standard change-of-mind policy provides for a 14-day exchange period, subject to the conditions set out in that policy.

This does not limit any statutory rights you may have under South African law.

In particular, where goods are defective or otherwise fail to meet the requirements of the CPA, you may have statutory rights to return the goods and request an applicable remedy, including repair, replacement or refund.

The CPA provides an implied warranty of quality and, in applicable circumstances, permits consumers to return goods within six months of delivery where the statutory requirements are met.

10. Online Consumer Rights

Because Oh, Belle operates an online store, certain provisions relating to electronic transactions may apply to your purchase.

Where required by applicable law, we will provide information relating to our identity and contact details, product information, pricing, delivery arrangements, payment methods and our cancellation, return, exchange and refund policies.

South African consumer legislation also provides specific rights in relation to certain transactions concluded through electronic communications.

Nothing in these Terms is intended to limit those rights.

11. Cancellations

Where South African law gives you a statutory right to cancel a transaction, we will honour that right in accordance with the applicable requirements.

12. Custom and Made to Order Products

Some Oh, Belle products may be custom-made, personalised or produced specifically according to a customer's requirements.

Where a product is custom-made or personalised, it may not qualify for a voluntary change-of-mind exchange.

However, custom or made-to-order products remain subject to any statutory consumer rights that apply, including rights relating to defective goods, goods that do not correspond with the agreed specifications, or other non-compliance with applicable law.

13. Intellectual Property

Unless otherwise stated, the content of the Oh, Belle website - including our brand name, logo, photographs, product designs, illustrations, graphics, text, videos, written content and other original materials - is owned by or licensed to Oh, Belle and is protected by applicable intellectual property laws.

You may view and use our website for your personal, non-commercial purposes.

You may not, without our prior written permission:

  • Copy or reproduce our original content for commercial purposes;

  • Reproduce or sell our designs;

  • Modify or distribute our content;

  • Use our branding or logo in a way that suggests an association with Oh, Belle;

  • Use our photographs or written content for another business; or

  • Reproduce substantial portions of our website content.

You may share links to our website or publicly available Oh, Belle social media content provided that you do not misrepresent the source or imply that Oh, Belle endorses or sponsors your use.

All rights not expressly granted to you are reserved by Oh, Belle.

If you choose to submit a review, comment, photograph, testimonial or other feedback to Oh, Belle, you remain responsible for ensuring that you have the necessary rights to submit that content.

By submitting content to us, you give Oh, Belle permission to use, reproduce and display that content for purposes connected with our business, including displaying customer reviews on our website or social media, where appropriate.

We will not knowingly use your personal information in a manner that conflicts with our Privacy Policy or applicable privacy law.

We may remove or decline to publish content that is unlawful, defamatory, misleading, abusive, offensive, fraudulent or infringes another person's rights.

We do not guarantee that all submitted feedback will be published.

Your purchase is a transaction between you and Oh, Belle. Shopify is our technology provider and is not the seller of Oh, Belle products.

Information submitted through our website may be processed by Shopify and other service providers in accordance with our Privacy Policy and their applicable policies.

To the extent permitted by law, Oh, Belle will not be responsible for losses that arise solely from circumstances outside our reasonable control.

However, this does not affect any rights or remedies you may have under applicable consumer protection legislation.

21. Limitation of Liability

To the extent permitted by applicable law, Oh, Belle will not be liable for indirect or consequential losses arising from your use of our website where such liability may lawfully be excluded.

However, this limitation does not apply to liability that cannot lawfully be excluded or limited, including where applicable law provides otherwise.

Nothing in these Terms is intended to exclude or limit liability for:

  • Fraud or fraudulent misrepresentation;

  • Intentional misconduct;

  • Gross negligence where liability cannot lawfully be excluded;

  • Death or personal injury where liability cannot lawfully be excluded;

  • Breach of statutory consumer rights; or

  • Any other liability that cannot legally be excluded or limited.

We will not be responsible for a failure or delay in performing an obligation where the failure or delay results from circumstances beyond our reasonable control.

Where such an event affects your order, we will take reasonable steps to communicate with you and minimise the impact.

We may update these Terms from time to time to reflect changes to our business, Services, technology or applicable laws.

The most recent version will be published on this website, together with the date on which it was last updated.

Where a change materially affects your rights or obligations, we will provide any notice required by applicable law.

Your continued use of the website after updated Terms have been published does not affect any rights that cannot legally be waived.

27. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or modified to the extent necessary to make it enforceable where legally possible.

If it cannot be made enforceable, the affected provision will be severed to the extent necessary, without affecting the validity of the remaining provisions.

If we do not immediately enforce a right or provision under these Terms, this does not mean that we have waived that right.

These Terms, together with our Privacy Policy and Returns, Exchanges & Refunds Policy, constitute the terms governing your use of our Services and your purchases from Oh, Belle, subject to any mandatory rights and obligations imposed by applicable law.
